With a membership drawn from the Bar as well as the Bench, it is a National Section of the International Commission of Jurists whose headquarter is in Geneva.

ImageThe criminal process is regulated under the Criminal Procedure Code (CAP 75) and the Evidence Act (CAP 80).
The responsibility of proving the guilt of the accused person lies with the prosecution. The court will not accept statements made by accused persons under torture.

The Kenyan Section of the International Commission of Jurists is concerned that the reparations scheme presented in Section 41 of the Truth, Justice, and Reconciliation Bill, 2008 is seriously flawed. These flaws may serve to prevent thousands of victims of gross human rights violations from receiving just reparations.

Even though the reasons for demanding a new constitution have been universally accepted, today it seems like the process of undertaking it was never agreed upon, although a Constitution of Kenya Review Commission was established and a National Constitution Conference convened subsequent to the Commission’s report and a draft Bill as provided for by the Constitution of Kenya Review Act.
