UPDATE: IDP Litigation
ICJ Kenya, represented by their advocates Mr. Chigiti and Mr. Githuka, appeared before Justice Lenaola on January 27, 2012 on preliminary matters concerning the public interest class action that was launched on behalf of victims of IDP camps.
Ms. Angote appeared for Kituo Cha Sheria and held brief for Ms. Musoga. They filed and served us, giving us notice that they intended to apply to become interested parties in the litigation. The content of their application supports our case and speaks to the IDP living conditions.
The first interested party, CREAW, was unrepresented and are yet to serve their pleadings on the parties.
The Court granted the following orders:
1. The court granted leave for interested parties to come on record.
2. It ordered all the parties, including the A.G., to file their papers (responses as well as affidavits) within 14 days of the hearing and in any event not later than the next mention date, which will be done for purposes of obtaining a hearing date.
3. The matter will be mentioned again on 17th February 2012 for hearing dates and directions on the form of hearing.
ICJ Kenya will continue to pursue this matter and seek to bring justice and compensation for all sufferers of IDP camps.
