Investigation and Prosecution of the Allegations against Amb. Bethuel Kiplagat before the TJRC

Amb. Kiplagat’s presence as the Chair of the Truth, Justice and Reconciliation Commission (TJRC) has paralysed its operations to the extent that ever since it was established close to a year ago, it has not embarked on its all-important mandate. Yet all this time, millions of taxpayer’s shillings have been squandered on the Commission, yet the victims of injustice that it is meant to serve go unattended to.

With a view to breaking the deadlock and move the truth, justice and reconciliation process for Kenya forward, the Kenyan Section of the International Commission of Jurists in collaboration of KEJUDE Trust, formally filed a complaint before the TJRC on 12th May, 2010 in accordance to the Commission’s mandate in Section 5 of the TJRC Act which gives it power to conducting investigations and hearings into gross human rights violations and economic crimes. We are filing this application to trigger the investigative powers of the Commission. We want the TJRC to investigate the grave allegations that have been made in public and recommend prosecutions against Hon. Kiplagat, and make such orders barring him from holding office as Chair of the TJRC
